There are many different ways you can use our services – to search for and share information, to communicate with other people or to create new content. When you share information with us, for example by creating a Simkl Account, we can make those services even better, to help you connect with people or to make sharing with others quicker and easier. As you use our services, we want you to be clear about how we’re using information and the ways in which you can protect your privacy.

Principles governing Simkl's data policy:

  1. Simkl has never and will never sell your information to anyone without your consent (with the exception of a business transfer).
  2. Simkl may sell aggregated data without device or user IDs (for example: Stats on most watched movies during last week).
  3. By creating an account using Email, Facebook, Google, Apple ID account or other platforms using the Sign in button options you are creating a public profile where some of the information you entered is visible to everyone unless you decide to make your profile private.
  4. You can make your Simkl profile private in Privacy Settings
  5. Simkl may share parts of your data with trusted third party partners to be able to provide you services and have a better experience on the website (for example when Simkl is using Google Analytics, shows you Google Ads or uses a service to create a support ticket, etc.)
  6. You can export your own data using free API https://api.simkl.com or backup tools at https://simkl.com/apps/backup/ like automated backups to your email.
  7. You can delete your account and all the data connected to your account or if you choose - only some specific data in Clean or delete your account Settings

What kinds of information do we collect?

To provide the Simkl Services, we must process information about you. The types of information we collect depend on how you use our Services. You can learn how to access and delete the information we collect by visiting the Simkl Settings.

Things you and others do and provide.

  • Information and content you provide. We collect the content, communications, and other information you provide when you use our Services, including when you sign up for an account, create or share content, and message or communicate with others. This can include information in or about the content you provide (like metadata), such as the Movie, Show or Episode you watched, which device you've used to watch (for example Desktop PC, Phone, Ipad or TV), which app you've used to watch (for example Netflix or Hulu). Information about how you watch, such as your daily viewing activity. Our systems automatically process content and communications you and others provide to analyze context and what's in them for the purposes described below.
  • Information and content you import. We collect content when you choose to import the data from other services using import tools and display this content inside your profile and settings. When using the Sign in with Facebook, Google, Apple, or other service options we may import your name, nickname, email, gender, date of birth, timezone, location, platform ID, Facebook User Access Token and other metadata if you have chosen to share these during the first sign in process. We also collect and store your service and app token metadata when connecting different accounts in login settings.
  • Networks and connections. We collect information about the people, accounts, shows, movies, anime, manga history that you like, watch or watched, listen to, and read, your comments, reviews hashtags, and groups you are connected to, and how you interact with them across our Services, such as people you communicate with the most or groups you are part of. We also collect contact information if you choose to upload, sync, or import it from a device when using the Find Friends options (such as an address book, phone numbers, emails, or call log or SMS log history, your Facebook friends, Twitter and other platform's followers if your specifically select to import them), which we use for things like helping you and others find people you may know and for the other purposes listed below.
  • Your usage. We collect information about how you use our Services, such as the types of content you view or engage with; the features you use; the actions you take; the people or accounts you interact with; and the time, frequency, and duration of your activities. For example, we log when you're using and have last used our Services, and what posts, videos, and other content you view on our Services. We also collect information about how you use features like our apps and API.
  • Information about transactions made on our Services. If you use our Services for purchases or other financial transactions (such as when you create a subscription to PRO or VIP plan or make a donation), we collect information about the purchase or transaction. This includes payment information, such as your credit or debit card number and other card information; other account and authentication information; and billing, shipping and contact details.
  • Things others do and information they provide about you. We also receive and analyze content, communications and information that other people provide when they use our Services. This can include information about you, such as when others share or comment on a photo of you, send a message to you, or upload, sync or import your contact information, or report your information to support, moderators, spam or abuse departments.

Device Information.

As described below, we collect information from and about the computers, phones, connected TVs and other web-connected devices you use that integrate with our Services, and we combine this information across different devices you use. For example, we use information collected about your use of our Services on your phone to better personalize the content (including ads) or features you see when you use our Services on another device, such as your laptop or tablet, or to measure whether you took an action in response to an ad we showed you on your phone on a different device.

Information we obtain from these devices includes:

  • Device attributes: information such as the operating system, hardware and software versions, battery level, signal strength, available storage space, browser type, app and file names and types, and plugins.
  • Device operations: information about operations and behaviors performed on the device, such as whether a window is foregrounded or backgrounded, or mouse movements (which can help distinguish humans from bots).
  • Identifiers: unique identifiers, device IDs, and other identifiers, such as from games, apps or accounts you use, and Family Device IDs (or other identifiers unique to Simkl Services associated with the same device or account).
  • Data from device settings: information you allow us to receive through device settings you turn on, such as access to your GPS location, camera or photos.
  • Network and connections: information such as the name of your mobile operator or ISP, language, time zone, mobile phone number, IP address, connection speed and, in some cases, information about other devices that are nearby or on your network, so we can do things like help you stream a video from your phone to your TV.
  • Cookie data: data from cookies stored on your device, including cookie IDs and settings, and this may include sending one or more cookies or anonymous identifiers to your device. We also use cookies and anonymous identifiers when you interact with services we offer to our partners, such as advertising services or Simkl features that may appear on other sites.
  • Log information: When you use our services or view content provided by Simkl, we may automatically collect and store certain information in server logs. This may include:
    • details of how you used our service, such as your search queries.
    • Internet protocol address.
    • device event information such as crashes, system activity, hardware settings, browser type, browser language, the date and time of your request and referral URL.
    • cookies that may uniquely identify your browser or your Simkl Account.
  • Location information: When you use a location-enabled Simkl service, we may collect and process information about your actual location, like GPS signals sent by a mobile device. We may also use various technologies to determine location, such as sensor data from your device that may, for example, provide information on nearby Wi-Fi access points and cell towers.
  • Local storage:We may collect and store information (including personal information) locally on your device using mechanisms such as browser web storage (including HTML 5) and application data caches.

Information from partners.

Advertisers, app developers, and publishers can send us information through Simkl API and other Simkl Services and Apps they use, including our social plug-ins (such as the Mark as Watched button, Add to List buttons), Simkl Login, our APIs and SDKs, Media Servers, Browser Extensions or App Plugins. These partners provide information about your activities off Simkl—including information about your device, websites you visit, items you like, watched, listened to or read, the ads you see, and how you use their services—whether or not you have a Simkl account or are logged into Simkl. For example, a TV App developer could use our API to tell us what TV Shows, movies, episodes you watched, or a business could tell us about a purchase you made in its store. We also receive information about your online and offline actions and purchases from third-party data providers who have the rights to provide us with your information. Partners receive your data when you visit or use their services or through third parties, they work with. We require each of these partners to have lawful rights to collect, use and share your data before providing any data to us.

How do we use this information?

To provide the Simkl Services, we must process information about you. The types of information we collect depend on how you use our Services. You can learn how to access and delete the information we collect by visiting the Simkl Settings.

Does Simkl share your personal information?

Information about our users is an important part of our business, and we are not in the business of selling our users' personal information to others. We follow practices at least as protective as those described in this Privacy Notice, and as described below.

  • Transactions involving Third Parties: We make available to you services provided by third parties. For example, you can purchase movie tickets from third parties through Showtimes & Tickets. You can tell when a third party is involved in your transactions, and we share users' personal information related to those transactions with that third party.
  • Third-Party Service Providers: We employ other companies and individuals to perform functions on our behalf. Examples include processing payments, removing repetitive information from user lists, analyzing data, providing marketing assistance, and transmitting content. They have access to personal information needed to perform their functions, but may not use it for other purposes.
  • Business Transfers: As we continue to develop our business, we might sell or buy other businesses or services. In such transactions, user information generally is one of the transferred business assets but remains subject to the promises made in any pre-existing Privacy Notice (unless, of course, the user consents otherwise). Also, in the unlikely event that Simkl or substantially all of its assets are acquired, user information will of course be one of the transferred assets.
  • Protection of Simkl and Others: We release account and other personal information when we believe release is appropriate to comply with the law; enforce or apply our Conditions of Use and other agreements; or protect the rights, property, or safety of Simkl, our users, or others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction.
  • We may share aggregated, non-personally identifiable information publicly and with our partners – like publishers, advertisers, or connected sites. For example, we may share information publicly to show trends about the general use of our services.

Other than as set out above, you will receive notice when personal information about you might be shared with third parties, and you will have an opportunity to choose not to share the information.

Public information.

Public information can be seen by anyone, on or off our Services, including if they don't have an account. This includes your Simkl username; profile picture and cover photo help people recognize you; Gender helps us describe you (example: "Add her as a friend"); Name or Nickname and any information you share with a public audience; Age range helps provide you with age-appropriate content; Language and country help us provide appropriate content and experiences; information in your public profile on Simkl. Public information can also be seen, accessed, reshared, or downloaded through third-party services such as search engines, APIs, and offline media such as TV, and by apps, websites, and other services that integrate with our Services.

Accessing and updating your personal information

Whenever you use our services, we aim to provide you with access to your personal information. If that information is wrong, we strive to give you ways to update it quickly or to delete it – unless we have to keep that information for legitimate business or legal purposes. When updating your personal information, we may ask you to verify your identity before we can act on your request.

We may reject requests that are unreasonably repetitive, require disproportionate technical effort (for example, developing a new system or fundamentally changing an existing practice), risk the privacy of others, or would be extremely impractical (for instance, requests concerning information residing on backup tapes).

Where we can provide information access and correction, we will do so for free, except where it would require a disproportionate effort. We aim to maintain our services in a manner that protects information from accidental or malicious destruction. Because of this, after you delete information from our services, we may not immediately delete residual copies from our active servers and may not remove information from our backup systems.

What about advertising?

We design our systems with your security and privacy in mind.

  • Third-Party Advertising and Links to Other Websites: Simkl Services may include third-party advertising and links to other websites and apps. Third-party advertising partners may collect information about you when you interact with their content, advertising, and services. We do not provide your name or other information that directly identifies you to these advertisers or third-party websites.
  • Use of Third-Party Advertising Services: We provide ad companies with information that allows them to serve you with more useful and relevant Simkl ads and to measure their effectiveness. We never share your name or other information that directly identifies you when we do this. Instead, we use an advertising identifier like a cookie or other device identifier. For example, if you have already downloaded one of our apps, we will share your advertising identifier and data about that event so that you will not be served an ad to download the app again. Some ad companies also use this information to serve you relevant ads from other advertisers.

How secure is information about me?

We design our systems with your security and privacy in mind.

  • We work to protect the security of your personal information during transmission by using encryption protocols and software.
  • We maintain physical, electronic, and procedural safeguards in connection with the collection, storage, and disclosure of personal customer information. Our security procedures mean that we may occasionally request proof of identity before we disclose personal information to you.
  • It is important for you to protect against unauthorized access to your password and to your computers, devices, and applications. Be sure to sign off when finished using a shared computer.

Are children allowed to use Simkl Services?

Simkl Services are not intended for use by children under the age of 13. If you are under 13, you may not sign up for Simkl Services or submit information about yourself to Simkl.

Information you give us when you use Simkl Services

You provide information to us when you:

  • search for information on Simkl Services;
  • subscribe to Simkl Services;
  • stream, view, or use content on a device or through a service or application on a device;
  • provide information in your user account (and you might have more than one if you have used more than one e-mail address when using Simkl Services) or on your Simkl name page;
  • upload professional contacts to your Simkl profile page;
  • configure your settings on, provide data access permissions for, or interact with Simkl Services;
  • submit content contributions (e.g., plot summaries and movie reviews);
  • communicate with us by email;
  • complete a questionnaire or a promotional entry form;
  • vote in a poll;
  • create an account using Facebook sign in;
  • create an account using Google sign in;
  • create an account using Apple sign in;
  • upload images or videos;
  • upload or respond to casting notices on Simkl;
  • use our services such as Showtimes & Tickets;
  • compile Watchlists or Lists;
  • participate in on-site forums, topics, and commenting;
  • track pages on Simkl; or
  • employ our notification services.
As a result of those actions, you might supply us with such information as:
  • identifying information such as your name, e-mail address, physical address, and phone number;
  • payment information;
  • your age;
  • your gender;
  • your location information;
  • your IP address;
  • your Facebook User Access Token;
  • your Google User Access Token;
  • your Apple User Access Token;
  • your acting experience and unique acting skills;
  • your educational background and professional training;
  • your physical attributes;
  • your general movie preferences;
  • the movies and actors you like or dislike;
  • people, addresses, and phone numbers of professional contacts on your Simkl profile page;
  • content of reviews, posts to on-site forums, and e-mails to us;
  • personal description and photographs you submit about yourself;
  • images and videos uploaded to Simkl Services; and
  • information and documents regarding identity (e.g., driver's license numbers).

Automatic Information

Examples of the information we collect and analyze include:

  • the internet protocol (IP) address used to connect your computer to the internet;
  • login, e-mail address, and password;
  • the location of your device or computer;
  • content interaction information, such as content streams, and playback details, and network details for streaming quality, including information about your internet service provider;
  • device metrics such as when a device is in use, application usage, connectivity data, and any errors or event failures;
  • Simkl Service metrics (e.g., the occurrences of technical errors, your interactions with service features and content, your settings preferences, location of your device running an application);
  • version and time zone settings;
  • purchase and content use history;
  • the full Uniform Resource Locator (URL) clickstream to, through, and from our websites, including date and time; content you viewed or searched for; and
  • page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs).
We may also use device identifiers, cookies, and other technologies on devices, applications, and our web pages to collect browsing, usage, or other technical information.

Information You Can Access

Examples of information you can access through Simkl Services include:

  • past payments;
  • subscription status;
  • personally identifiable information (including name, e-mail, and password);
  • payment methods;
  • e-mail notification settings;
  • your content contributions (e.g., plot summaries and movie reviews);
  • profile information associated with your Simkl accounts (including your reviews, ratings, and Watchlists);
  • information associated with your Simkl profile page (including acting experience, physical attributes, educational background, and professional training); and
  • images uploaded to Simkl Services.

How can I manage or delete information about me?

We provide you with the ability to access, rectify, port, and erase your data. Learn more in your Simkl Settings. You can delete your information and account in Login and Password settings then click Clean or delete your account and follow the instructions. (Please make sure to be logged into your account to be able to delete the account automatically). Alternatively, you can use our Support Portal to request the account deletion.

We store data until it is no longer necessary to provide our services and Simkl Services, or until your account is deleted - whichever comes first. This is a case-by-case determination that depends on things like the nature of the data, why it is collected and processed, and relevant legal or operational retention needs. If you submit a copy of your government-issued ID for account verification purposes, we delete that copy 30 days after review, unless otherwise stated.

When you delete your account, we delete things you have posted, such as your photos, and status updates, watch history, watch lists, reviews, comments, followers, payment data, and you won't be able to recover that information later. Information that others have shared about you isn't part of your account and won't be deleted. If you don't want to delete your account but want to clean your watch history you can do that as well. To delete your account at any time, please visit the Simkl Settings.

How do we respond to legal requests or prevent harm?

We access, preserve and share your information with regulators, law enforcement, or others:

  • In response to a legal request (like a search warrant, court order or subpoena) if we have a good faith belief that the law requires us to do so. This may include responding to legal requests from jurisdictions outside of the United States when we have a good-faith belief that the response is required by law in that jurisdiction, affects users in that jurisdiction, and is consistent with internationally recognized standards.
  • When we have a good-faith belief it is necessary to: detect, prevent and address fraud, unauthorized use of the Products, violations of our terms or policies, or other harmful or illegal activity; to protect ourselves (including our rights, property or Services), you or others, including as part of investigations or regulatory inquiries; or to prevent death or imminent bodily harm. For example, if relevant, we provide information to and receive information from third-party partners about the reliability of your account to prevent fraud, abuse and other harmful activity on and off our Services.

Information we receive about you (including financial transaction data related to purchases made with Simkl) can be accessed and preserved for an extended period when it is the subject of a legal request or obligation, governmental investigation, or investigations of possible violations of our terms or policies, or otherwise to prevent harm. We also retain information from accounts disabled for terms violations for at least a year to prevent repeat abuse or other term violations.
